TERMS AND CONDITIONS
Global Tracks, Inc. (herein after GT) located at 1855 S. Pueblo Blvd, Pueblo, CO 81005, in return for full payment by you for the amount specified is responsible to arrange for the transportation, accommodations and other services specified in promotional materials and/or contract(s) and subject to the following terms and conditions. Unless expressly specified as included, other services, taxes and fees are not included.
Responsibility: GT and Global Garden Adventures act only as agents for the passenger in regard to travel whether by motorcar, motor coach, ship, train or airplane and assume no liability for injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason of defect in any vehicle or for any reason whatsoever, or through the acts or defaults of any company or person engaged in conveying the passengers or in carrying out the arrangements of the tour. GT and Global Garden Adventures does not own, manage, and control or operate any transportation vehicle, hotel or restaurant or any other supplier of services. GT can accept no responsibility for losses or additional expenses due to delay or changes in air or other services, sickness, weather, strike, war, quarantine or other causes. All such losses or expenses will have to be borne by the passenger as tour rates provide for arrangements only for the time stated. The right is reserved to substitute hotels of similar category for those indicated and to make any changes in the itinerary deemed necessary or caused by changes in air schedules. GT reserves the right to cancel any tour prior to departure, in which case full refund will constitute full settlement with the passenger. No refund will be made for any unused portion of the tour unless arranged prior to departure. The issuance and acceptance of vouchers/tickets shall be deemed to be consent to the above conditions. The airlines and their agents and affiliates are not to be held responsible for any act or omission, or event during the time passengers are not on board their aircraft. The issued passenger ticket shall constitute the sole contract between the airlines and the purchaser of these tickets and/or the passenger.
Prices: Pricing may include agreements to pay vendors in foreign currency. All prices are quoted using the prevailing exchange rate between the foreign currency and the USD from the date the contract was drafted. If the exchange rate increases by more than 4%, Global Tracks reserves the right to adjust the program costs according to the current market exchange rate. GT reserves the right to increase prices in the event of any increased security or fuel related surcharges, increases imposed by the airline or other vendors that may be in place at the time of ticketing or travel, foreign or domestic tax increases, or adverse currency exchange fluctuations, after August 1, 2010.
Failure to remit any deposit or payment when due shall result in a cancelled booking and shall be subject to the cancellation and/or late fees established by GT.
Baggage: Baggage is at owner’s risk entirely. GT cannot be held responsible for lost or damaged luggage. You should give immediate notice of any lost or damaged luggage to the involved air carrier, hotel, and to your own insurance company. The passenger is responsible for any baggage charges imposed by the airline.
Passport/Visas and Aircraft Boarding: Once issued, and prior to departure air tickets are non refundable. After scheduled flight departure, unused tickets and portions of tickets are non refundable. Names are required as they appear on the passenger’s passport. Name changes may result in penalty charges. GT cannot be held responsible for airline delays. Aircraft boarding privileges are limited to persons whose full payment and signed agreement has been received by GT. All persons must also present a passport with at least 6 months validity and positive proof of identity when boarding. Improper documentation, inadequate proof of identity, inadequate proof of age for children under 2, or any other reason may result in denial of boarding privileges. All persons are responsible to have any necessary visas required. If GT is to assist with acquiring visas, they cannot be held responsible for any last minute visa policy changes by a foreign consulate. If you are denied boarding privileges, you forfeit all monies paid and will be assessed any non-recoverable costs.
Insurance: Trip cancellation, health and accident insurance, is available and highly recommended to protect you against unforeseen circumstances which cause you to interrupt or cancel your trip.
If you change plans or cancel, your rights to a refund are limited. Please note written cancellation policy elsewhere in this contract. No refunds will be made for any portion of the arrangements we have made for you that are not actually utilized by you.
LIABILITY COVERAGE: Global Tracks carries two million dollars Travel Agents and Tour Operators Professional Liability Insurance with Berkely Agency and the Zurich American Insurance Company .
